Understanding Your Role as Employer of Record

The Employer of Record (EOR) is a central part of Consumer-Directed services.

The EOR assumes applicable employer responsibilities for the attendant.

Virginia Medicaid specifically identifies hiring, training, managing, and terminating attendants as employer responsibilities within the Consumer-Directed model.

The EOR May Be Responsible For:

Recruiting

Finding potential attendants who can meet the individual’s needs.

Interviewing

Speaking with applicants to assess fit and qualifications.

Selecting & Hiring

Choosing and hiring attendants according to applicable requirements.

Training

Ensuring attendants understand the individual’s needs and care preferences.

Scheduling

Managing when and how services are delivered.

Supervising

Overseeing the quality and consistency of service delivery.

Reviewing Service Delivery

Monitoring worked time and whether services match the authorized plan.

Addressing Concerns

Handling performance issues when they arise.

Backup Planning

Maintaining a plan for when the regular attendant is unavailable.

Terminating

Ending employment of an attendant when appropriate.
